The wrongful death lawsuit filed by the daughter of Paul Walker has just taken another turn.
USA Today is reporting that attorneys representing Meadow Walker, who filed a wrongful death suit against Porsche for the death of her father Paul Walker, have uncovered damaging emails sent by Porsche employees regarding the Carrera GT. During the holidays a member of Ms. Walker’s legal team was reviewing case documents (stored on a CD-ROM) on a personal iMac. The redacted emails Porsche provided during the discovery phase were able to be seen on the iMac but not the lawyer's work-provided PC.

The emails are not protected under attorney-client privilege nor are they considered protected work product. The new information is damning in that it shows Porsche employees acknowledging the seemingly unsafe nature of the Carrera GT in a lighthearted way. As many as 200 of the 1,200 Carrera GTs which Porsche produced had been 'totaled' in the first two years it was sold (2004-2006)," one Porsche employee wrote in an email exchange about a body shop employee who had just wrecked another example of the supercar. The email continued with, "Another Carrera GT bites the dust. Looks like he was going more than 30 (mph) to me!”

The author followed up by asking if the crash stats were correct, because if so that would be “"great news to the remaining owners as the GT becomes more rare." Other redacted information revealed via iMac magic included the identities of witnesses and marketing material touting Porsche Stability Management (PSM), a feature purposefully left off the Carrera GT. If Porsche knew Carrera GTs were crashing like crazy at the same time it was touting the merits of PSM that's not good. In the motion for terminating sanctions—Porsche could be fined $53,000 for refusing to share evidence in full—lead attorney Jeffrey L. Milam gave a scathing review of the automaker’s conduct in the case.

Plaintiff has no assurance this practice will cease, and based on (Porsche's) misconduct, plaintiff can no longer rely on any statements or representations by defense counsel." The German luxury automaker has successfully defeated a lawsuit filed by the widow of Roger Rodas, Walker’s friend and the person behind the wheel during the crash. This new development may make it harder for the company to defeat the other two suits it is facing related to Walker’s death (his dad has also sued).
